Terms of Service

These terms are the agreement between you and KSRAT when you use our website or app, or buy coaching from KSRAT Online or KSRAT Studio. By signing up, paying, or using the app, you accept them. Please read them with our Privacy Policy and Refund & Cancellation Policy, which form part of these terms.

1. Who we are

KSRAT is a fitness coaching business based in Delhi, India. KSRAT Online and the KSRAT app are run by Megellan Fernandes. KSRAT Studio, Gulmohar Park, Delhi, is run jointly by Megellan Fernandes and Mehul Saini. "We" and "us" mean KSRAT. "You" means the client.

2. Who can sign up

You must be 18 or older and able to enter a contract. Each account is for one person. Keep your password private. You're responsible for what happens under your account.

3. What we do, and what we don't

We provide fitness coaching: training programmes, nutrition guidance, accountability and progress tracking.

We are not doctors, physiotherapists or dietitians. Nothing we provide is medical diagnosis, treatment or rehabilitation, and it doesn't replace advice from your doctor. If a coach suggests you see a medical professional, please do.

4. Health screening comes first

Before coaching starts you must complete the health screening (PAR-Q), accept the liability waiver, and give data consent in the app. If your screening shows a risk, or you're recovering from an injury or surgery, you need medical clearance before training. Tell your coach straight away if your health, injuries or medication change.

5. Your part

• Give honest, complete health information.
• Train within your limits. Stop and tell your coach if you feel pain, dizziness or distress.
• Don't train while injured beyond what you're cleared for, acutely ill, or under the influence of alcohol or drugs.
• Follow your coach's instructions and the studio rules, and treat staff and other members with respect.

Results are not guaranteed. They depend on consistency, effort, sleep, nutrition, genetics and health, which are partly outside our control.

6. Plans and payment

• Prices and what's included are shown when you choose a plan, and on your receipt.
• KSRAT Online plans are a fixed coaching period (for example 3 months) at a fixed price. Overseas clients may be billed in their own currency.
• KSRAT Studio plans are monthly session plans (for example 12 sessions a month, 3 a week).
• Payment is due at the start of each plan or cycle, by UPI, bank transfer or cash, unless we agree a different date with you in writing or in the app. Every payment gets a receipt.
• Taxes, where they apply, are shown on your receipt.
• Plans don't renew automatically. We'll remind you before yours ends, and you choose whether to renew.

7. Refunds, pauses and cancellations

These are covered by our Refund & Cancellation Policy.

8. KSRAT Online

• You get a personal plan, regular check-ins, and coach feedback through the app and WhatsApp.
• We aim to reply to each check-in within 48 hours. That depends on you sending your check-in on time.
• It doesn't include in-person sessions.
• Coaching sold by a coach under their own name, outside KSRAT, is between you and that coach, not KSRAT.

9. KSRAT Studio

• Sessions are booked in advance with your assigned coach.
• Cancel at least 24 hours before a session and it isn't counted. Later cancellations and no-shows count as used.
• Sessions in a monthly plan are for use within that month. Unused sessions don't carry over unless we agree in the app or in writing.
• Use equipment only as shown. Tell your coach about any injury before the session.

10. Risk and liability

Exercise carries a risk of injury. You take part voluntarily and accept that risk.

To the extent the law allows:

• we are not liable for injury, illness or loss from your training, unless it is caused by our negligence or misconduct;
• we are not liable for indirect loss, or for results that fall short of your goals;
• our total liability for any claim is limited to the fees you paid for the plan the claim relates to.

Nothing here limits any liability or consumer right that Indian law doesn't allow us to exclude.

11. Our content

Programmes, plans and materials we give you are for your personal use only. Please don't share, sell, publish or use them to coach others.

12. Ending coaching

You can stop at any time under the Refund Policy. We may pause or end your coaching if you break these terms, give false health information, are abusive to staff or members, or if continuing would be unsafe. If we end it for any other reason, you get a refund for what's unused.

13. The app and website

We work to keep the app available and your data safe (see the Privacy Policy), but we can't promise it will never be down or error-free. Don't misuse it: no trying to access other people's accounts, no automated scraping, and no interfering with how it works.

14. Changes

We may update these terms. The version and date above show what applies. Changes won't reduce what you've already paid for, and we'll tell active members about important changes.

15. Law and disputes

These terms are governed by the laws of India. Let's try to sort out any problem directly first: contact us using the details in section 1. If that fails, the courts in Delhi have jurisdiction, without affecting any consumer rights you have where you live.
